General terms and conditions for the English ARCADEMI AFFAIRES Shop
§ 1 Scope:These Terms and Conditions apply to sale and delivery of items in the ARCADEMI AFFAIRES Shop to private consumers and other purchasers. For purchasers who are not private consumers the terms of contract apply with the exception of the right to cancel as stated in § 4.
The following terms do not apply to other services offered by ARCADEMI.
§ 2 Conclusion of contractOrders are submitted via the website www.arcademi.com/affaires.
You first choose the item you wish to purchase and add it to your virtual cart. Before you can submit the order you will be asked to check the data you entered and to correct it if necessary.
Once you have entered and checked the billing and delivery address and chosen a payment method you may submit the order by clicking the “Submit order” button. Receipt of your order will be confirmed by e-Mail.
Only after an e-Mail confirming shipment has been sent to you a legal contract will be concluded between you and us. No contract will be concluded on products that are not stated in the shipment confirmation.
§ 3 Prices, delivery and payment modalitiesAll prices stated are EURO prices. They include the legal VAT. Shipping costs will automatically be added to the order and apply according to the given delivery address.
Delivery carriers are DHL or Deutsche Post.
ARCADEMI reserves the right to deliver contractual services as partial deliveries. Any additional shipping costs caused will be covered by ARCADEMI. If more than one item are purchased shipping costs only apply once. There are no extra charges.

Payment can be done either in advance or via PayPal.The items will be shipped within 48 hours once payment has been received on our accounts. Any costs and charges for international money transfers will be covered by the purchaser.
Advance payment:We will send you an e-Mail confirming your order. Once we have received the payment on our accounts the goods will be shipped. Please transfer the payment stating the invoice number only after you have received the order confirmation.

Instructions on the right to cancel and restoration of goodsInstruction on the right to cancel for consumers
Right to cancel
You may cancel your declaration of contract within one month without giving any reasons in written form (e.g. letter, fax, e-Mail) or – if the goods were handed to you before expiry of the time limit - by sending back the goods. The time limit begins after receipt of these instructions in text format, however not before the goods have reached the recipient (if the same goods are delivered repeatedly not before receipt of the first partial delivery) and also not before fulfillment of our obligations of information according to § 312c Abs. 2 BGB in association with § 1 Abs. 1, 2 and 4 BGB-InfoV as well as our obligations according to § 312e Abs. 1 Satz 1 BGB in association with § 3 BGB-InfoV. In order to observe the cancellation period it is sufficient to send the cancellation or to restore the goods in time. Cancellation needs to be sent to:

Consequences of cancellation
If the cancellation has been effective the mutually rendered services need to be restored and obtained benefits (e.g. interests) need to be rendered as applicable. If you cannot restore the obtained service fully or only partially or only in a degraded state to us you might need to provide compensation for lost value as applicable. This does not apply if the degradation has occurred exclusively by checking the item, as it would have been possible in a regular shop. If degradation has been caused by regular use of the item according to its intended purpose you will not have to provide compensation for lost value. Items that can be shipped as parcels need to be returned to us at our risk. You need to cover for the return shipping costs if the delivered goods correspond to the ones that have been ordered and if the price of the returned good is not higher than 40 Euros or, in case the price is higher than 40 Euros, if at the time of cancellation you have not yet provided the equivalent service or a contractually agreed partial payment thereof. In all other cases the return shipping is free of charge for you. Items that cannot be shipped as parcels will be picked up. Payment restoration obligations need to be fulfilled within 30 days. For you, the period of payment restoration begins as soon as you send out the declaration of cancellation or the item; for us upon receipt thereof.

§4 a Agreement on cost responsibility If you use your right to cancel you need to cover the periodical costs for return shipment if the delivered goods correspond to the ones that have been ordered and if the price of the returned good is not higher than 40 Euros or, in case the price is higher than 40 Euros, if at the time of cancellation you have not yet provided the equivalent service or a contractually agreed partial payment thereof. In all other cases the return shipping is free of charge for you.
§ 5 Warranty Warranty is governed by general legal provisions.
- In case of a deficiency the customer can choose if supplementary performance is to be provided through rectification or replacement delivery. However, we are able to refuse the method of supplementary performance chosen by the purchaser if it can only be provided in association with disproportionately high costs and if the other method of supplementary performance can be provided without involving considerable detriment to the customer.
- If supplementary performance has failed or if we have refused supplementary performance at all, the customer can demand either price reduction or cancel the contract. Potential claims for damages by the customer remain unaffected by this.
- Warranty is granted for 2 years for new goods, as from passing of risk.

§ 7 Data storage We, ARCADEMI GmbH, take protection of your personal data very seriously and comply with the regulations on data protection. Personal data on this website will only be collected as far as necessary for technical reasons. The obtained data will not be sold or given to third parties for any other reasons.
The following explanation provides an overview of how we ensure protection and which type of data will be collected for which purpose.
